The 2024 income tax return

The 2024 income tax return is reporting your income over the calendar year 2024. This implies you report your world wide income and your world wide assets.

Those who hold the 30% ruling obtained before January 1, 2024 have the choice to file the Box 3 world wide assets or not, till the end of their 30% ruling. In the year the 30% ruling ends, you pro rata report Box 3 assets.

Employees who obtained the 30% ruling during 2024 only have such a choice for one time, being this tax return. The next tax return, 2025 and onwards, the world wide assets are to be reported.

Do you need to file the 2024 income tax return?

In the Netherlands we have roughly 5 million tax residents who have a source of income. That can  be employees, entrepreneur or dividend receivers. The Dutch tax office is not keen to invite 5 million tax residents to file their tax return, hence the do not.

Who is not invited to file the 2024 income tax return?

The employee who has one employer, the same employer the full year. This employee does not own a house, did not use tax credits for day care, rent or healthcare. This employee has no assets exceeding EUR 57.000. That employee is not invited to file.

If you are not invited to file, could you still have an obligation to file?

The moment you are not invited to file the income tax return. At the same moment, as you ought to know the law, you are aware, or you should be aware you need to file a tax return. That is the moment you need to file a tax return. This moment cannot be later than 14 days after the May 1 deadline.

Any tax resident of the Netherlands need to ought to know the law. Please relax, most of us do not know the law. Nevertheless, that is the base on which the Dutch tax office holds you accountable.

The moment you own, combined with foreign savings accounts and investments accounts, more than the EUR 57.000 threshold in world wide assets, you are to file a tax return.

The moment you received a reimbursement for book royalties, speakers fee or another income, you are to file a tax return. The year you switched from employer, you are to file a tax return.

The above is not a limited list, but an indication of what could trigger for you as a filing obligation.

When should you be keen to file an income tax return?

The year you migrated to the Netherlands or from the Netherlands, could be an interesting year to file the income tax return. Due to privacy rules the employer cannot use the knowledge of you moving your tax residency. Hence the employer needs to withheld the wage tax amount as if you earned this salary the full year.

Example, you earn a EUR 80.000 salary and you move from the Netherlands in April, or you arrive in September in the Netherlands, the 49,5% tax bracket is applied for 1/12 by the employer. However, you did not work a full year and the number of months you did work, did not make you reach the 49,5% tax bracket.

That makes it interesting to at least have us check if the migration income tax return is resulting in a refund. Also the social premiums play a part in this. If you were already invited to file, you have no choice.

I have been invited to file a tax return, but I have nothing to report, do I need to file?

The tax office does not know it all, even though they might claim that. If you have been invited to file, the tax office is under the assumption you have something to report. Till you file, the tax office has no reason to assume  otherwise.

The day you do not meet your requirement as for you it is obvious there is nothing to report, that is the day you receive a penalty for not filing your income tax return. Please do as is expected from you within the time frame set.

We think tax is exciting, we are excited to file your tax income return. Indeed you can ask your colleague to file your tax return. Yes, you can even go on line with the Dutch tax office to file your income tax return. But are your worldwide assets reported correctly, in case of a house purchase, are the correct deductible costs reported.
