Have you employed staff that is actually working on the site of a client, as if you are an employment agency, is your company Waadi proof?

In case your company employs one or more employees that you delicate to another company on basis of an employment agency agreement or on basis of a secondment agreement or an other agreement. You receive a fee, the employee is working under the authority of the other company, then your company needs to comply with the Waadi regulations.

The Waadi regulations have been implemented to prevent the employee being exploited, under paid, working illegally.

You become Waadi proof when you register your company with the Dutch Chambers of Commerce and have indicated that the company is subject to the Waadi regulations. If you do not have a Dutch company, but you qualify with your foreign company under the Waadi rules, then you still need to register your foreign company to meet the Waadi requirements. The result is that the salary specification of the employee shows the correct salary meeting the minimum requirements, social premiums are paid, reservations are made and a Stipp pension is arranged for.

The Waadi regulations are monitored by the social instituted and if it turns out that you should have been Waadi registered and you are not, then the fine per employee is EUR 12.000.

A solution for the above mentioned problem is using the services of a payroll company. A payroll company is Waadi proof and solves this issue for a fee that is marginal compared to the fine. In this respect we suggest to contact Dutchpayrolling.nl. At EUR 250 per month per employee you have become Waadi proof.

Your Annual Income Statement (jaaropgaaf)

The Annual Income Statement (AIS) is a document stating your annual income, income tax deducted and any applied credits. Your employer will issue it early in the year after the year of the tax return.

Please also give details of benefits with the AIS from the UWV.

NB Salary slips are not the same as an AIS. If you cannot obtain your AIS, we can use your salary slips but these may not be accurate and may be updated by the figures given to the Tax Office by your employer.

If you have foreign income, send us the AIS for this if possible. Otherwise provide salary slips. We also need to know if the work was performed abroad or remotely from NL.
